Purchase Agreement

By agreeing to purchase merchandise from AvantGardeFurniture.com, you are accepting and agreeing to be bound by each of the following terms and policies (also referred to as "Agreement").

 

Delivery 

 

All orders are shipped via ground carriers. Processing usually takes 24-48 hours upon verification and approval. Your merchandise is shipped out in the next 1-3 business days. You should receive your merchandise from 1 to 14 days after the purchase, depending on your location. If you are in NYC, NJ, CT, DC, MD, or parts of PA, you may receive your merchandise on the same or the next day. For our customers in NY, NJ, FL, VA, MD, NC, SC, DC, GA, PA, CT, MA, DE, and RI, we offer free Platinum Delivery Service for most of the products. Our Platinum Delivery Service includes; Free Hand Delivery + Free Inside Placement (to the room of your choice) + Free Full Professional Assembly. In all other states we offer our free superior Silver Delivery Service, which includes free Inside Delivery. "Inside Delivery" means that the furniture will be brought into your home, to the first dry area of your residence, such as your apartment, foyer, or garage, but the boxes will not be unpacked by the delivery team. In any case, we are the best at the market when it comes to performing the deliveries, with a zero percent damage rate. Please specify any special delivery instructions in the comments area provided at the checkout page. The shipping time quotes are only estimates, not guaranteed. When it comes to orders and deliveries, we are depending on the factory and delivery carriers to provide us with the estimated delivery dates. We do our best to deliver it in time. 
 

 

Order Cancellation

All orders might be canceled within 24 hours of placement or before the ordered products are placed in transit, whichever comes first.  No cancellation fee will apply at this point.  Please feel free to contact us and cancel the order.  However, if merchandise is in transit, the customer still may cancel the order, but then the customer may be charged for the cost of round-trip shipping of merchandise. The same rules may apply if the customer refuses to accept furniture at the time of delivery and it is returned back to us without notification. Note that special orders may not be canceled.  A special order is an order of custom furniture in terms of size, material, or color pattern; a floor model item; a clearance item; an inventory sale item; or an items sold subject to a special discount. 

 

Return

We offer a 7-day, restocking fee-free, Return Policy starting on the day when the merchandise is received by a customer. You may return an item for a refund or exchange, excluding any shipping and handling charges, within a period of 14 calendar days. Please contact our customer service department for a Return Merchandise Authorization number (RMA) and instructions prior to shipping merchandise back. Any merchandise received without a Return Authorization number will not be accepted. Enclose the original receipt or a copy of it with your return. Also, enclose a brief explanation letter of a return and state your request for either a refund or an exchange. Please include the authorization number on this letter and not on the outside of the box. Never write anything on the manufacturer's box. The customer is responsible for shipping charges on returns or exchanges. Exchanges and returns may only be made within 7 calendar days of receiving the merchandise if the return is in the original box, in mint (brand-new) condition, never installed, never used, with all original packaging material included. Returned merchandise will be inspected, prior to refund, to ensure that it is returned damage-free, in the original box, in mint (brand-new) condition, never installed, never used, with all original packaging material included. Please note that the mattresses, bedding, and linens are non-refundable and cannot be returned or exchanged. In case the merchandise is damaged within the 30-day period or thereafter, the customer’s rights shall be limited to the manufacturer’s warranty. Return in case of Damage in Transit

Merchandise can be returned by reason of damage in transit within 3 days of its receipt by the customer.  Damaged merchandise may be returned or exchanged free of charge only if the damage is detected during inspection upon delivery.  You should notify the carrier and document it on the papers that the “merchandise was damaged in transit”. It is the duty of the customer to inspect the product at the time of receipt, document and photograph any deficiencies, defects, or damage, and contact our customer support as soon as possible.  In the event that the driver refuses to wait for you to complete inspecting the furniture, then the notation " truck driver refused to wait, possible damages " must be entered on the paperwork presented by the driver before you sign it. AvantGarde Furniture will not be responsible for damaged freight if the delivery receipt is signed without any documentation that carrier damages were not detected. If there is transit-related damage observed after the acceptance of merchandise, the damaged merchandise may still be returned or exchanged, subject to freight charges and the replacement costs, if any, only if the customer contacts our customer support within 72 hours following the delivery. 

 

Refunds

Once the returned item has been received and verified to have all original contents and packaging, never installed, never used, and be free of damage, the refund credit process will begin. Returns without original packaging, once installed, or visibly used may not be refunded. A refund will be issued for the products returned during the 7-calendar-day trial. Customers will be refunded via the same method in which the item was purchased. Merchandise returned without the proper MRA number or sent to the wrong location will not be accepted. Merchandise returned or refused at delivery for any reasons without notification and proper RMA number will not be refunded. Clearance, special orders, or items marked as final sale or marked as non-refundable items are not subject to return and refund. 

 

Certificate of Insurance

In rare cases some co-op / condominium building managements may require a Certificate of Insurance to be presented by delivery personnel at the time of delivery. Without this paperwork your building management won’t let the delivery team perform the delivery inside the building. The customer is responsible for notifying us prior to placing an order if their management requires a COI so that the delivery team can come prepared with the COI. 

 

Elevators

This section does not refer to multi-story houses, only multi-story buildings. Please inform us if your multi-story building does not have an elevator. The delivery personnel may refuse to lift up the boxes if they weren’t informed of the absence of an elevator in the building. In this case, the customer will still have to accept the furniture and lift it up themselves or pay the amount determined by the delivery company for them to complete the delivery. If the customer refuses to accept the furniture, then a twenty percent restocking fee along with round-trip shipping fees will be withheld from the refund. So, please, contact us prior to placing an order.

 

Measure your space

Please be sure to measure your selected area, as well as stairwells, doorways, and hallways, to ensure the merchandise will fit in / through those areas. The delivery team cannot be responsible if the merchandise is too large to fit your space or doorways, so the delivery cannot be completely performed. If it doesn't, the delivery company may have to leave the product right outside your door, on a porch, or in a garage. Please review all dimensions prior to placing an order.

 

Condition of Product

Finishes, color, texture, and graining variations can occur in natural products like leather, wood, and stone. These are not normally considered imperfections. The leather of all colors, including black and white, is bound to have variations in every production line. Color representations on computer terminals and screens can be different based on settings and various display technologies.  Again, such variations are not considered product defects.  The customer agrees that he or she may not and will not seek any refunds, make any claim, or initiate any dispute based on the finish, color, texture, or any other physical attribute after accepting delivery of a product. 

 

Information Corrections

Although these cases are rare, there may be information on AvantGarde Furniture that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice, whether or not relevant orders are pending.
